9 - 10 A.M. Morning Prep Session: Overview of Key Issues and Talking Points
10 A.M. - 2:30 P.M. Meetings with Legislators and/or their Key Staff Members. Meetings on the schedule include Senators Rivera, Cleare, and Stavisky and Assemblymembers Weprin, Paulin, McDonald, Fahy and Stirpe.
2:30 - 3 P.M. Debrief

Join us for the New York State Society of Plastic Surgeons' Albany Advocacy Day on Tuesday, May 2, 2023. This event is an opportunity for our members to come together and advocate for important legislative priorities that impact plastic surgery patients and providers throughout the state.

Our mission is to advance quality care for plastic surgery patients and promote public policy that protects patient safety. To achieve these goals, we have identified key legislative priorities for 2023 that we believe will have a significant impact on our patients and practices.

Priorities include:

  • S2680 (Breslin) / A859 (McDonald) – Modeled off of laws enacted in other states, the legislation would grant exemption from prior authorization for a particular health care service when practitioner has been approved 90% of the time.
  • S3400 (Breslin) – Requires that health plan utilization review criteria be evidence-based and peer reviewed, reducing the insurer timeframe for reviewing prior authorization requests (from 3 days to 72 hours and 24 hours in emergency) and limiting when an insurer can withdraw or repeat a previously granted prior authorization.
  • S6146 (Cleare)/A5729 (Paulin) – Requires insurers to provide coverage for tattooing of the nipple-areolar complex pursuant to or as part of breast reconstruction surgery if such tattooing is performed by a physician working within their scope of practice.
  • S5638 (Jackson) – Legislation restores the integrity of the New York State Emergency and Surprise Bills Law through removal of the Qualifying Payment Amount as a factor to consider in the New York Independent Dispute Resolution process.
  • S5639-A (Jackson) – The legislation clarifies that the New York state health insurance program remains subject to certain provisions of the financial services law and coverage for usual and customary costs for out-of-network health care service.
  • Truth in Advertising – Recognizing growing patient and public confusion over the types of health care practitioners as well as their education, training, and experience.
  • Clinical Peer Reviewer 2022 Bill Numbers: S8113 (Cleare) / A879 (Gottfried)– Redefines who is a clinical peer reviewer for purposes of utilization review under Public Health Law and Insurance Law.
  • Laser Hair Removal – Support legislation that requires appropriate level of education, training, and hands on experience of laser hair removal technicians with supervision by a Dermatologist, to assure patient safety and high-quality care recognizing incidences of patient harm.
  • S5520 (Rivera) / A5012 (Solages) – Removes physician supervision for physician assistants

  • Medical Malpractice – NYSSPS opposes one-sided legislation and urges comprehensive medical malpractice reform, which is integral to maintaining and supporting the health care workforce and access to care.
